DUGGIN AND WIFE V. RAILWAY COMMISSIONERS.
M. Scholes, instructed by Mr. H. S. Williams, appeared for the plaintiffs; and Sir Julian Salomons, Q.C., Mr. West, Q.C., and Mr. G. H. Simpson, instructed by Mr. J. C. Thom (Solicitor for Railways), for the defendants.
This was an action brought by Henry James Duggin formerly carrying on the business of dairyman and poulterer at Botany, and Mary Jane Duggin, his wife, against the Railway Commissioners of New South Wales to recover compensation for injuries sustained by the female plaintiff through the alleged careless and negligent driving of the defendant's servants while in charge of a motor and tram.
The case of the plaintiffs was as follows :- On the afternoon of Saturday, the 1st July of last year, Mrs. Duggin, who had been to market to sell poultry, was driving home along the Botany road, and had reached a spot between Epsom and Waterloo roads when she noticed an omnibus coming from Botany, and a tram some distance behind. At tthis time it was not dark, and Mrs. Duggin could plainly see the driver of the 'bus on the box, and she was driving on the tramline on the proper side. The tram overtook the omnibus, and when both were about 30 yards from the female plaintiff she tried to pull of the line but found there was no room between the 'bus and the motor. Ramsey, the driver of the 'bus, seeing the difficulty she was in, held up his whip as a signal to the motor-driver to stop, and he also called out to him. The man on the motor apparently eased off a little, but he suddenly accelerated the speed of the motor, and before Mrs. Duggin could get clear the hind part of one wheel of the vehicle was struck, the result being that the cart was capsized, and Mrs. Duggin and her son were both thrown violently into the road. The boy was not seriously hurt, but Mrs Duggin sustained a severe injury to her left knee, one arm was also somewhat hurt, and she was bruised. She was removed to the Prince Alfred Hospital upon the advice of a medical man, and it was found that the kneecap was distended by fluid. She remained in the hospital for about five weeks , and for eight weeks afterwards her leg was in plaster of Paris. For a period of 12 months she was unable to assist in either in the housewrk or her husband's business, and at present could not get about for any distance without the aid of a crutch or stick, the kneejoint apparently permanently affected.
For the loss of his wife's services, and the expense incurred for medical attendance, &c, the male plaintiff claimed 1500 pounds, and an additional 500 pounds as personal compensation to Mrs. Duggin. The defendants pleaded not guilty, and called evidence to prove that the collision occurred through the negligence of the female plaintiff. The fireman of the motor, who was on the lookout at the time, said that when he saw Mrs. Duggin coming along Botany-road driving a horse attached to a milkcart she was in a safe position. When the motor was within five yards of the vehicle, however, he noticed that the horse had swerved, and was backing the cart on to the line in front of the motor. He at once called out to the motor-driver, who immediately put on the brakes and reversed, and this was so far effectual that, although the collision could not be absolutely avoided, the force of the impact was not very servere. The plaintiff's horse, however reared, and one of the wheels of the cart becoming entangled in the motor bar, the vehicle capsized, and Mrs. Duggin was thrown out.

Damages amounting to 450 pounds were awared to Henry J. Duggin against the railway commissioners in the Supreme Court today as compensation sustained by his wife, Mary Jane Duggin. A cart which Mrs. Duggin was driving ran into a tram car and she was thrown out and seriously injured.
